Appenzell : Premier randonneur nu devant la justice
Habitant de Herisau, le seul à s"être fait pincer dans le demi-canton en 2009, est accusé de "comportement indécent". Comme il n"a pas payé l"amende de 100 francs, l"homme se retrouvera jeudi prochain devant le Tribunal cantonal. Un procès qui coïncide avec l"ouverture officielle de la saison de randonnée naturiste, en Allemagne du moins.
Car en Appenzell, malgré les gros titres dans les médias, on ne peut pas dire que la marche dans le plus simple appareil ait suscité un formidable engouement. A moins que les intéressés se soient montrés très discrets. En effet, la police des Rhodes-Extérieures n"a pincé que le quidam en question, tandis que celle des Rhodes-Intérieures faisait chou blanc.
Interdit pas la Landsgemeinde
En 2009, la Landsgemeinde des Rhodes-Intérieures a décidé d"interdire explicitement la randonnée naturiste, avec à la clé une amende de 200 francs. Cette décision faisait suite à la première observation en 2008 d"adeptes de cette discipline dans le massif de l"Alpstein, qui avait choqué et révolté une partie de la population.
Les Rhodes-Extérieures ne disposent pas d"un article de loi spécifique. Ce sera au Tribunal cantonal de dire si le "comportement indécent" s"applique en l"espèce.
Harcèlement
A St-Gall, des promeneurs naturistes ont suscité un certain émoi l"an dernier dans le Toggenburg, sans suites toutefois. Là non plus, l"interdiction n"est pas explicite, mais un tel comportement pourrait tomber sous le coup du harcèlement, y explique-t-on.
Les Allemands, eux, ne se laissent pas impressionner. Il va y en avoir des gens à arrêter à travers l"europe.
Parce que, mine de rien, la randonue progresse de plus en plus, jour après jour,
que les autorités le veuille ou non.
Le seuil à dépasser pour qu"elle ne soit plus hors la loi c"est combien ?

S"il s"agit du fameux randonneur suisse "Puistola" (ou même sinon), il y a (pour le moment) cet entretien récent avec lui à la chaîne SF (Schweizer Fernsehen):
"Puistola" fait sa entrée dans le studio nu, mais s"habille pour les douze minutes d"entretien. Malheuresement mon allemand simple est inutile pour comprendre l"allemend suisse! Nous-aidez, quelqu"un?

Maintenant j"ai découvert que l"article originale (celle du lematin.ch) fait rapport d"un autre monsieur suisse qui était le premier en Suisse d"être arrêter pour la randonnue en 2008. L"audience aura lieu, évidemment, jeudi prochain. "Puistola" va l"aider dans une manière quelconque. Mon correspondent suisse (Urs) m"a promis de renseigner sur le résultat..

Il s"appelle Peter G. Il s"agit d"une condamnation en 2009 pour "unanständiges Benehmen" (conduite inacceptable même indécent) et d"une amende de SFr 100,- contre laquelle il a mis un appel dans la cour cantonale d"Appenzell-Außerrhoden. L"audience était aujourd"hui..

Un promeneur naturiste a comparu pour la première fois devant la justice en Appenzell Rhodes-Extérieures. Cet habitant de Herisau, le seul à s"être fait pincer dans le demi-canton en 2009, est accusé de "comportement indécent". Le jugement sera rendu ultérieurement.
L"homme âgé de 46 ans s"est retrouvé devant la justice car il a refusé de payer l"amende de 100 francs que la police lui a envoyée et a fait recours. S"il était condamné, il devrait payer en plus des frais de justice se montant à 870 francs.
Le défenseur de l"accusé a plaidé l"acquittement. Il a fait valoir que le code pénal n"est plus un code moral depuis 1992. Selon lui, le promeneur nu ne s"est pas comporté de façon indécente et n"a gêné personne. La femme qui l"a dénoncé a dû le suivre pour l"observer, a-t-il déclaré.
L"accusé choisit toujours des chemins peu fréquentés pour s"adonner à son hobby, a poursuivi le défenseur. Là où il y a du monde, il ne se sent pas bien, "nu ou habillé".
L"accusé a confirmé se promener sans habits depuis environ deux ans. Il se baigne également nu dans les lacs et les rivières l"été. La plupart des gens qu"il croise le saluent amicalement. Certains se moquent de lui.
Contrairement aux Rhodes-Intérieures, les Rhodes-Extérieures ne disposent pas d"un article de loi interdisant la randonnée naturiste. C"est maintenant au Tribunal cantonal de dire s"il y a eu en l"espèce "comportement indécent" ou non.

The local population is not happy about naked ramblers in their midst A court case over the question of whether people are allowed to hike naked is set to begin in Switzerland.
It is the first case since the eastern Swiss canton of Appenzell introduced a new public order law last year, which permits naked hikers to be fined.
The case centres on an appeal from a man who was fined for rambling while naked.
Canton Appenzell has become a popular destination for those who like to hike without clothes.
But the local population is deeply unhappy about it.
Conservative region
The hiker in question was fined after eyewitnesses complained that he had been hiking in full view of a communal barbecuing area. They also say he walked past a Christian care home, whose residents saw him.
Appenzell is traditionally a rather devout and conservative region of Switzerland. It only gave women the vote in 1990 and its growing reputation as a paradise for naked hikers is not popular with locals.
Authorities hope the new public order law would be a deterrent to naked ramblers.
But the problem is that Swiss federal law states that public nudity is not a crime, so the hiker is now appealing against his fine.
His appearance in court today - fully clothed this time, it"s expected - could be the start of a long and costly legal process, which may end up in Switzerland"s highest court..

Le premier randonneur naturiste jugé en Appenzell Rhodes-Extérieures a été acquitté.
Les conditions du "comportement indécent" ne sont pas remplies, a estimé le tribunal cantonal
à Trogen (AR). L"Etat devra payer les frais de procédure de 2000 francs.
La justice appenzelloise a donné raison au randonneur, qui avait refusé de payer l"amende de 100 francs
qui lui avait été infligée. Une femme avait déposé plainte contre le promeneur en octobre dernier après
l"avoir surpris, nu, sur un sentier pédestre près de Herisau.
L"homme de 47 ans avait passé, dans le plus simple appareil, devant une place de pique-nique bien
fréquentée ce jour-là ainsi que devant une institution chrétienne de réadaptation pour toxicomanes.
Contrairement aux Rhodes-Intérieures, les Rhodes-Extérieures ne disposent pas d"un article de loi
interdisant la randonnée naturiste.
Le défenseur de l"accusé avait plaidé l"acquittement.

The hills are alive with the joys of nudity in Switzerland after its courts ruled that ramblers had the right to roam around naked. Our writer joined the hikers
Puistola Grottenpösch looks out across a jagged Swiss horizon, the early-summer snow still fresh on the higher pastures. "I always had the feeling I was alone," he says, bending over to touch an alpine orchid. "I went on secret walks, early in the morning — hiding behind bushes and feeling unlawful." We reach an electric fence, and he turns suddenly before straddling it. "Be careful," he says, "that your little brother is not electrocuted."
My little brother is cold, as it happens, but unharmed. It, along with the rest of me, is 2,000m (6,561ft) up a Swiss mountain — here to experience the joys of naked hiking, in the month when its advocates won the right to roam freely in the Swiss Alps. Puistola no longer walks alone. Not since he started appearing in the courts. These days he is — reluctantly — one of the world"s most prominent naked hikers.
"I never wanted to start a hubbub," he says of his celebrity — that has led to appearances on Swiss chatshows and in papers around the world. "I"m not a militant. But they started making trouble."
The trouble began two years ago. And "they" are the Swiss courts. In 2008 a man was arrested while naked hiking in the mountainous Appenzell region. He argued, successfully, that Swiss law is not a moral codex — and has no prohibitions on nudity. But as a result, one of the Swiss cantons changed its laws so as to make naked hiking an offence. When another hiker was arrested, Puistola — a long-time practitioner of the sport, as well as having some legal experience — offered to represent him. The law, he argued successfully last month, was itself superseded by Swiss federal law.
"It is now accepted there is no law in Switzerland against naked hiking," Puistola says. "The people have given us the freedom to be naked." He swings slightly — whether in the wind, which is bracing, or from excitement, which is evident, it is difficult to tell. But the battle is not over, the canton is appealing the decision.
Naked hiking is a sensitive issue in Switzerland. Across the border, Germany has as many as 12 million naturists, but there is a deep streak of conservatism in Swiss society — especially in the Roman Catholic cantons. This is a country that gave full suffrage to women only in 1990. Appenzell Innerrhoden, the last canton to hold out against the female vote, still requires that its citizens vote in person, in the main town square, by a show of hands. Men bring swords. Not entirely coincidentally, it is also the canton that brought the most recent action.
Puistola says that in the ensuing coverage he and his friends have been described as psychopaths and perverts, weirdos and neurotics. Which is why, as well as fighting in the court for his right to be naked, he is fighting for it in the court of public opinion — inviting journalists to accompany him and experience naked hiking themselves.
"You are welcome to join," he explained in an e-mail to me after his legal victory. "Together with friends I go hiking in the buff in the alps almost all year round, on Wednesdays usually." So it is that, three Wednesdays later, at the top of a chairlift in a small valley north of Zurich, Puistola is advising me on the necessity of all-over suncream. "Not all of your body is used to the sun, he says." Puistola"s body has a Kilroy-Silk level of all-over tan.
Behind us, some clothed hikers (called "textiles" by naturists) walk past — looking at us and then trying not to look as if they are looking at us. Puistola"s friend Dorian, a man in a red G-string and excellent moustache, has given me a small cloth in case we pass through heavily populated areas. "Wrap it quickly around yourself and you"re decent," he advises, demonstrating. Then he removes his G-string.
The stories of how Dorian, Puistola — and their female friend Ursina — began naked hiking are remarkably similar. All of them began in secret, before finding each other on the internet, glorying in the discovery that they were not alone. "I didn"t dare do it for so long because I thought people would think wrong things," Ursina says. "Then I started, but only in hidden places. I love to feel the sun on all of my skin.
Dorian agrees. "It"s a break from the daily grind. I can feel the wind on my whole body." For Puistola it"s "freedom, simply freedom. Do you feel it?" he asks. I don"t. Scanning the hillside ahead for any other walkers, I feel dread. And looking at the grinning photographer, I feel embarrassment.
But I am grateful for Dorian"s cloth — even if, after the start, we meet few other hikers. Waiting on the snowline, Dorian has found another use for his. Wrapped around his head in a turban, he stands silhouetted proud against the sky, as if a naked Lawrence of Arabia. "We"re not against clothes," he says. "They are practical. I was just thinking of putting on gloves — fingers are the first extremity to get cold." That is not, as it happens, the case for me.
We get even colder as we stop to wait for the fully-clothed Times" photographer, who has fallen behind. "You can see," Dorian says pointing at him, struggling below, "it"s harder to get up here if you have to work against clothes." This isn"t entirely fair. The photographer could also be tired because he spent part of the hike running around the hillside searching for flowers to place strategically in shot as alpine fig leaves.
Puistola, however, warms to the theme. "That is true, he is in jeans. They have to bend — he has to struggle against them. They get sweaty, then cold." A lack of clothes has other, less obvious, advantages. Dorian sweeps his hand across a wooded hillside on the opposite side of the valley. "You see that forest?" he says. "It is called, in English, the Arse Forest." The Arse Forest? "Yes." And he is able to slap the appropriate part demonstratively.
For all his evangelism, Dorian"s real name is not Dorian. And for all Puistola"s court appearances, his name is not Puistola. Neither want to be identifiable in pictures. Ursina (also not her real name) doesn"t want to appear in any pictures. Puistola is worried about what his father would think, Dorian about his work colleagues. "It would be embarrassing," Dorian says. "They have been mouthing off at work about the nude hikers and I"ve been quiet." When the hiker was arrested in 2008, Dorian had been in the same region. "They knew I"d been there," he says of his colleagues. "They joked that the hiker was me".
At the same time as Switzerland is battling over the right to be naked, an equally acrimonious battle is being fought over the right to wear the burka. The irony is not lost on Puistola. "It is both ends of the sausage," he says. "The same people against us are against the burka. They talk about freedom, but they mean only their freedom. They don"t think of law, they think only of order — and it is the order of their prejudices".
He points to the mountain top on which, in the snow, there is a Crucifix. "One day I will go on a hike with a lady in a burka and put a crescent at the top. That will annoy them".
The strange thing is that both debates happen almost entirely in the absence of examples. Burkas are rare here. And, despite the dire predictions in the Swiss press, Puistola says that he knows of just a few dozen who share his hobby. So the Swiss hills are not, yet, alive with the sight of nudity.
What is still not clear to me, as we near the summit, is why all of this matters so much — why make so much fuss just to be naked. And then, as we reach the Crucifix, there is a gap in the clouds. Along the ridge, snowy peaks jut out in a line for as far as we can see while, a vertical kilometre below, cows with cowbells jangle their way through the pastures. The Arse Forest is ruffling in the breeze.
It is glorious. And it is glorious to flinch from the wind, revel in the sun. I feel — yes, there is only one word — free. Then I put on my clothes. It"s bloody cold.
Naked world
* Steve Gough, known as the Naked Rambler, part-funded his 2003 quest to walk naked from Land"s End to John O"Groats with the prison discharge grant. Often arrested then promptly released, he sometimes received the statutory sum every week. But today the courts are less lenient. His latest sentence was 21 months, imposed by a Perth court in February. He conceded then he may effectively be in jail for life, as the police wait for him to leave prison — naked — then instantly rearrest him.
* Germany is a land of nudists but not of rule-breakers. For Teutonic naked hiking to take off, it must be legitimate. So a campsite in Saxony has built an 18km path in the Harz mountains. A sign at its start reads: "If you don"t want to see naked people, then you shouldn"t go past this point".
* In the US, June 21, 2010 was Naked Hiking Day. Police say it is difficult to judge the annual day"s popularity. "We have a lot of remote territory out there," says Captain Woody Lipps, a national forests officer in Virginia.
* The Singles Outdoor Club (soc-uk.info) organises naturist walks in "pleasant countryside in reasonably unpopulated areas", though hikers should bring cover-up clothing just in case. Its next walk is the first Thursday in August, in Arundel, West Sussex.
